Acceptance of Terms

By accessing or using Quiz by Prazdnik.top (the "Platform", "Service") operated by Prazdnik.top ("we", "us", "Company"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Platform.

These Terms apply to all users — hosts, players, account holders, guests, and administrators. Use of the Platform constitutes your agreement to these Terms as amended from time to time.

Description of Service

Quiz by Prazdnik.top is a web-based live interactive quiz platform that allows registered users ("Hosts") to create, manage, and run quiz sessions, and allows participants ("Players") to join sessions via PIN or QR code. Features include real-time leaderboards, multiple question types, team mode, lead capture forms, custom branding, and analytics export.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Account Registration and Security

To access host features you must register an account with a valid email address and a password of at least 6 characters. You are responsible for:

• Providing accurate registration information;
• Maintaining the confidentiality of your login credentials;
• All activity that occurs under your account;
• Notifying us immediately at finunigpt@gmail.com of any unauthorised account access.

We reserve the right to suspend or terminate accounts found to be in violation of these Terms, used for abuse, spam, or fraudulent purposes, or inactive for more than 24 months.

Acceptable Use

You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• Use the Platform to distribute harmful, offensive, defamatory, or illegal content;
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure;
• Reverse-engineer, decompile, or attempt to extract source code;
• Use automated tools, bots, or scripts to interact with the Platform without prior written consent;
• Resell or sublicense access to the Platform without authorisation;
• Collect personal data from other users without appropriate consent;
• Use the Platform in a manner that degrades performance for other users;
• Submit false or misleading information through any form on the Platform.

Violation of these terms may result in immediate account termination and, where applicable, legal action.

User Content and Intellectual Property

5.1 Your Content

You retain ownership of quiz content you create (questions, answers, titles, images). By submitting content to the Platform you grant us a non-exclusive, worldwide, royalty-free licence to store, display, and process that content for the purpose of providing the Service.

5.2 Our Intellectual Property

The Platform, its design, code, trademarks, logos, and all related materials are the intellectual property of Prazdnik.top. Nothing in these Terms grants you any right to use our trademarks, logos, or brand names without prior written consent.

5.3 Aggregate Data

We may collect anonymised, aggregated data derived from usage of the Platform and use it for analytics, product improvement, research, and commercial purposes. Such data does not identify individual users and is not subject to these content ownership provisions.

Lead Capture — Host Responsibilities

Hosts who enable lead capture functionality take on the following obligations:

• Obtain and display an appropriate consent notice to players before collecting their personal data;
• Use collected lead data only for lawful purposes consistent with the consent obtained;
• Comply with applicable data protection laws including GDPR, CCPA, and equivalent legislation in the host's jurisdiction;
• Not share lead data with third parties without appropriate legal basis;
• Retain lead data only for as long as necessary.

The Platform provides lead capture as a technical service only. Prazdnik.top is not responsible for how hosts use, store, or share lead data collected through their events. Hosts assume full legal responsibility for their data processing activities.

Subscription Plans and Payments

The Platform offers a Free tier (3 quizzes, unlimited players) and a Pro tier (unlimited quizzes, CSV export, lead capture, custom branding). Pro tier pricing is as published on the Pricing page and is subject to change with 30 days' notice.

Payments are processed securely. We do not store payment card data. Subscription fees are non-refundable except where required by applicable consumer protection law. Downgrading from Pro to Free preserves existing quizzes but restricts the creation of new quizzes beyond the free limit.

We reserve the right to suspend access to paid features upon non-payment or suspected fraud.

Availability and Uptime

We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. The Platform may be unavailable due to maintenance, updates, infrastructure failures, or circumstances beyond our control. We provide no Service Level Agreement (SLA) on the Free tier. Pro tier uptime commitments, if any, are provided in a separate agreement.

Automatic game closure after 30 minutes of inactivity is a designed feature, not a service failure.

Disclaimer of Warranties

Limitation of Liability

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount paid by you to us in the 12 months preceding the claim, or €100, whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless Prazdnik.top and its operators from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with: (a) your use of the Platform; (b) content you create or submit; (c) your violation of these Terms; (d) your violation of any applicable law or the rights of any third party; or (e) your use of lead capture in breach of applicable data protection law.

Termination

You may delete your account at any time by contacting finunigpt@gmail.com. We may suspend or terminate your account immediately and without notice if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or caused harm to other users or to the Platform.

Upon termination, your right to use the Platform ceases immediately. Quizzes and session data associated with your account will be handled in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination (including §9, §10, §11) will continue to apply.

Amendments

We may update these Terms at any time. Material changes will be communicated by email to registered account holders and/or by a prominent notice on the Platform at least 14 days before taking effect, except where immediate changes are required by law. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which Prazdnik.top operates, without regard to conflict-of-laws rules. Any dispute arising from these Terms shall be resolved by good-faith negotiation in the first instance, followed by binding arbitration or litigation in the courts of the Controller's domicile. Where you are a consumer in the EU/EEA, you also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
